1. Overview

DraftMyListing provides AI-assisted real estate listing content generation for For Sale By Owner (FSBO) home sellers. By using our service, you agree to these terms.

2. Service Description

For a one-time fee of $49, DraftMyListing generates a listing package that includes an MLS-ready listing description, social media posts, a property feature sheet, open house talking points, and a printable property brochure. Content is generated using artificial intelligence based on the property information you provide.

3. AI-Generated Content Disclaimer

All content produced by DraftMyListing is generated with the assistance of artificial intelligence. While we strive for high-quality, accurate output, you acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or omissions.
  • You are solely responsible for reviewing, editing, and verifying all generated content before using it in any listing, advertisement, or communication.
  • You should not publish or distribute any generated content without first confirming its accuracy.
  • DraftMyListing does not guarantee the accuracy, completeness, or suitability of any generated content.
  • DraftMyListing is not responsible for any consequences resulting from your use of the generated content, including but not limited to listing errors, misrepresentations, or lost sales.

4. Not Real Estate Advice

DraftMyListing is not a licensed real estate agent, broker, or advisor. Our service provides marketing copywriting assistance only. We do not provide real estate advice, property valuations, pricing recommendations, or legal guidance. For professional real estate advice, consult a licensed real estate professional in your area.

5. Your Responsibilities

  • You represent that the property information you provide is accurate and truthful to the best of your knowledge.
  • You are responsible for ensuring your listing complies with all applicable local, state, and federal real estate disclosure laws and regulations.
  • You are responsible for reviewing all generated content for accuracy before use.
  • You will not use the service to create fraudulent, misleading, or deceptive property listings.

6. Payment & Refunds

  • Payment of $49 is a one-time charge processed securely by Stripe.
  • Your listing package is generated immediately after payment and delivered on-screen and via email.
  • Due to the digital nature of the product, all sales are final. However, if you are unsatisfied with the quality of your listing package, email info@draftmylisting.com and we will work with you to make it right.

7. Intellectual Property

Once you purchase a listing package, you own the generated content and may use it freely for marketing your property. DraftMyListing retains no ownership rights to your generated listing content.

The DraftMyListing name, logo, website design, and underlying technology remain the property of DraftMyListing.

8. Limitation of Liability

To the maximum extent permitted by law, DraftMyListing and its owner(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service or any generated content.

Our total liability for any claim related to the service shall not exceed the amount you paid for the specific listing package in question ($49).

9. Indemnification

You agree to indemnify and hold harmless DraftMyListing and its owner(s) from any claims, damages, losses, or expenses arising from your use of the generated content, your property listing, or your violation of these terms.

10. Account Termination

We reserve the right to suspend or terminate your account if we believe you are using the service in violation of these terms or for fraudulent purposes.

11. Changes to These Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.

12. Fair Housing Compliance

DraftMyListing is committed to compliance with the Fair Housing Act. Our AI content generation is designed to avoid discriminatory language based on race, color, religion, sex, national origin, familial status, or disability. However, you are responsible for reviewing all generated content to ensure it complies with all applicable fair housing laws before publication.

13. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts.
